This website is operated by 47 Peaks LLC, doing business as Kelvin Eyewear (“we”, “us”, “our”), Albuquerque, NM 87110, United States. By visiting our site or purchasing from us, you agree to these Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy, which are incorporated by reference.

1. Eligibility

You must be at least the age of majority in your place of residence to place an order. You may not use our products or site for any illegal or unauthorised purpose.

2. Products and descriptions

We make every effort to display colours, dimensions and features accurately. Monitor settings can affect how colours appear and slight variations between product photos and the item may occur. Our sunglasses provide UV400 protection; they are not intended for direct viewing of the sun or for use during a solar eclipse. Blue light glasses are comfort eyewear and are not a medical device; they do not diagnose, treat or prevent any condition. Kelvin non-prescription eyewear does not replace an eye examination.

3. Pricing and availability

Prices are shown in the currency selected and may change without notice. We reserve the right to modify or discontinue products, limit quantities and refuse or cancel any order, including orders placed with an obvious pricing error. If we cancel an order after payment, we refund you in full.

4. Orders and payment

An order is a request to buy; a contract is formed when we confirm shipment. You agree to provide current, complete and accurate purchase and account information. Payments are processed by secure third-party providers; we do not store full card details.

5. Shipping, returns and warranty

Shipping, returns and warranty are governed by our Shipping Policy and Refund Policy. Risk of loss passes to you on delivery.

6. Intellectual property

All content on this site, including the Kelvin name, logo, product names, photography, text and design, is owned by or licensed to 47 Peaks LLC and may not be reproduced without written permission.

7. User content and comments

If you send us reviews, photos, ideas or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish it in connection with our business. You confirm the content is yours and does not infringe anyone’s rights.

8. Third-party links and tools

We may link to third-party sites or tools that we do not control. We are not responsible for their content or practices.

9. Limitation of liability

To the fullest extent permitted by law, 47 Peaks LLC is not liable for any indirect, incidental or consequential damages arising from the use of our site or products. Our total liability for any claim is limited to the amount you paid for the product concerned. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

10. Indemnification

You agree to indemnify and hold 47 Peaks LLC harmless from any claim arising out of your breach of these terms or your violation of any law or the rights of a third party.

11. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. If you are a consumer residing in the EU, EEA, UK or Switzerland, you also benefit from the mandatory consumer protection provisions of your country of residence.
